A constable may arrest without warrant: 경찰은 다음과 같은 조건을 충족하는 경우에 한하여 영장없이 피의자를 체포할 수 있다. -Anyone who is about to commit an offence or anyone whom he has reasonable grounds for suspecting to be about to commit an offence; 범죄를 저지르려는 사람 또는 범죄를 저지를 것이라고 경찰이 충분한 근거 하에 짐작하는 사람 -Anyone who is in the act of committing an offence or anyone whom he has reasonable grounds for suspecting to be committing an offence; 범죄를 현재 저지르고 있는 사람 또는 범죄를 현재 저지르고 있다고 경찰이 충분한 근거 하에 짐작하는 사람 -Anyone who is guilty of an offence or anyone whom he has reasonable grounds for suspecting to be guilty of an offence. 범죄를 저지른 사람 또는 범죄를 저질렀다고 경찰이 충분한 근거 하에 짐작하는 사람 -However, a constable may only arrest without warrant if it is necessary to arrest the person for any of the following reasons: 하지만, 다음과 같은 사유 하에서 경찰은 필요할 시에 영장없이 체포할 수 있다. a. To enable the name of the person in question to be ascertained (in the case where the constable does not know, and cannot readily ascertain, the person’s name, or has reasonable grounds for doubting whether a name given by the person is his real name); 현재 조사중인 피의자의 이름을 확인하기 위하여 (이 경우는 경찰이 이름을 모르거나 명확하게 이름을 확인할 수 없거나 제시된 이름이 가명일 가능성을 충분한 근거 하에 의심할 경우에 한한다) b. Correspondingly as regards the person’s address; 현재 조사중인 피의자의 주소를 확인하기 위하여 c. To prevent the person: 현재 조사중인 피의자가 다음과 같은 행위를 하는 것을 방지하기 위하여 • Causing physical injury to himself or another; 자신이나 타인에게 신체적 부상을 입히는 경우 • Suffering physical injury; 신체적 부상을 입은 경우 • Committing an offence against public decency; or 공공윤리에 반한 범죄를 행하는 경우 • Causing an unlawful obstruction of the highway; 고속도로 통행을 불법적으로 방해하는 경우 d. To protect a child or other vulnerable person from the person in question; 현재 조사중인 피의자로부터 미성년자나 다른 약자를 보호하기 위하여 e. To allow the prompt and effective investigation of the offence or of the conduct of the person in question. 현재 조사중인 피의자가 저지른 범죄나 행위에 대한 수사를 신속하고 효율적으로 하기 위하여 f. To prevent any prosecution for the offence being hindered by the disappearance of the person in question. 현재 조사중인 피의자가 사라짐으로써 범죄에 대한 기소가 늦추어지는 것을 방지하기 위하여 The most common reason given for arrest is (e) above. Suspects are usually arrested and taken to the nearest police station for the purposes of preserving/obtaining evidence and for interviewing the suspect. 경찰은 피의자를 체포하는 가장 일반적인 사유는 e항 에 의거한다. 피의자들은 통상 증거 확보와 조사를 목적으로 체포되어 가장 가까운 경찰서로 인도된다. A person must be told as soon as practicable that he is under arrest otherwise the arrest is unlawful. This is so, even if the fact that he is being arrested is obvious. 피의자는 최대한 빨리 자신이 체포되었다는 사실을 통보받아야 하며 그렇지 않을 경우 체포는 불법적이다. 그가 체포되었다는 사실이 비록 자명할지라도 분명히 통보받아야 한다. A person must be informed of the ground for arrest at the time of the arrest or as soon as practicable after the arrest, otherwise the arrest is unlawful. Again, this is so even If the grounds are obvious. 피의자는 최대한 빨리 자신이 체포된 이유를 통보받아야 하며 그렇지 않을 경우 체포는 불법적이다. 그가 체포된 이유가 비록 자명할지라도 분명히 통보받아야 한다. A person must also be told why arrest was believed to be necessary, although failure to do so will not render the arrest unlawful. 피의자는 왜 체포가 불가피했는지에 대한 이유도 통보받아야 하나, 통보받지 못했다고 하여 체포가 불법적인 것은 아니다. The above information need not be given by the arresting officer but may be given by a colleague. 위의 내용은 피의자를 체포한 경찰관이 아닌 동료 경찰관이 통보하여도 무방하다. A person must be cautioned at the time of arrest or as soon as practicable afterwards unless it is impracticable to do so because of his condition or behaviour at the time. Failure to administer a caution does not render the arrest unlawful but it may provide grounds for exclusion of evidence at trial. 피의자는 피의자의 상태나 행동 때문에 통보되지 못한 경우를 제외하고는 체포 당시 또한 체포 후 최대한 빨리 법적권리에 대해 통보받아야 한다. 법적권리에 대한 내용을 통보하지 않을 경우 체포가 불법으로 간주되지는 않으나 재판에서 증거제외의 빌미를 제공할 수도 있다.
